Notary and witness do different jobs
A witness watches you sign and signs to say so. A notary verifies your identity, confirms you are signing willingly, and completes a certificate that carries legal weight beyond a simple signature.
Some documents need only a notary. Some need witnesses as well. A few need witnesses and no notary at all.
Documents that typically need two witnesses in Florida
- Deeds transferring real estate, including quitclaim deeds.
- Powers of attorney.
- Wills, which have their own strict formalities and belong with an attorney.
- Certain healthcare and advance directive documents.
- Any document whose own text includes witness lines — if it asks, it needs them.
Who can be a witness
An adult who is competent, who is not named in the document and does not benefit from it, and who has valid identification. Neighbours, colleagues and adult friends usually qualify. The person receiving the property or the power does not.
Spouses and relatives are often allowed but can weaken a document if it is ever challenged. If there is any chance of a dispute, choose neutral witnesses.
Can the notary be the witness?
I do not do it. Florida allows it only in limited circumstances, and combining both roles is exactly the kind of detail an opposing lawyer looks for later.
Arrange your witnesses in advance. It is the single most useful thing you can do before a deed or power of attorney appointment.
Witnesses in an online session
Remote online notarization platforms can supply witnesses who appear in the same session, verified the same way the signer is. That solves the problem when you cannot find two people at short notice, and it is one of the quiet advantages of signing online.
