The three conditions
A notarization at a bedside needs the same things as any other, and they are not negotiable:
- The signer is awake and aware of what the document is.
- The signer can communicate that understanding themselves — a nod to a question asked by a relative is not enough.
- The signer is acting willingly, without anybody in the room pressing them.
- There is valid identification, or a credible witness who has their own.
When I will have to say no
If medication, exhaustion or illness means the person cannot follow the conversation that day, I cannot notarize. I know that is the last thing a family wants to hear, and I would rather say it than sign something that gets challenged later, when it matters even more.
Sometimes the answer is to come back in the morning, when the person is clearer. Sometimes it is to speak to an attorney about other routes. I will tell you plainly which one I think it is.
Practical things that help
- Check the facility's visiting hours and rules before we set a time.
- Have the document complete and unsigned, and know which notarial act it needs.
- Arrange witnesses in advance if the document requires them — staff often cannot serve, and anyone named in the document cannot either.
- Find the signer's identification early; it is often at home rather than in the room.
- Pick a time of day when the person is usually at their best.
What usually gets signed
Powers of attorney, so a relative can handle banking and paperwork. Advance directives and healthcare-related documents prepared by an attorney. Affidavits and insurance forms. Occasionally, real estate documents when a sale is underway.
I do not prepare any of them, and I cannot tell you which one you need. Have an attorney prepare it; then I come and handle the signing.

- How quickly can you get there?
- Hospital and care facility visits get priority when the schedule allows, often the same day, including evenings.
- My relative can nod but not speak. Is that enough?
- Usually not. They must be able to communicate understanding and willingness themselves. Tell me the situation beforehand and I will be straight with you.
- Can hospital staff be witnesses?
- Many facilities do not allow it. Plan to bring your own adults who are not named in the document.
- Can this be done online instead?
- Sometimes, though Florida adds protections when the signer is a vulnerable adult, usually requiring a witness present with them.
